CHILD 802 VISA & CHILD VISA 101
The Child Visa Subclass 101 or 802 is intended for children who have a parent who is an Australian citizen, a permanent resident, or an eligible New Zealand citizen. These visas enable such children to reside permanently in Australia. The key difference between the two is that the 101 visa is for applicants outside Australia, while the 802 visa is for those already in the country.
In terms of sponsorship, these visas differ from others in that they require sponsorship by an eligible parent. An eligible parent is defined as a parent (or their partner), or step-parent of the child who is over the age of 18 and is a settled Australian citizen, a permanent resident, or an eligible New Zealand citizen. The Department also allows step-parents who no longer have a partnership with the child’s parent but have a legal responsibility for the child under 18, as well as adoptive parents who adopted the child before they became an Australian citizen, a permanent resident, or an eligible New Zealand citizen, to sponsor the child.
To be eligible for either a 101 or 802 visa, you must:
- Have an eligible sponsor
- Be single
- Be one of the following:
- Under 18 and not adopted
- Under 18 and adopted
- Between 18 and 23 and a full-time student
- 18 or older with a disability that prevents them from working and dependent on their sponsoring parent
- Meet specific health requirements and, if over 16, certain character requirements
