EMPLOYER NOMINATION SCHEME 186 VISA
The Australian Employer Nomination Scheme provides an opportunity for Australian businesses to hire overseas workers within Australia when they can’t initially fill the roles with Australians due to shortages. This scheme offers international workers a permanent skilled position. The Subclass 186 visa comprises two different tiers that an applicant can apply from. Each of these tiers follows a two-step application process. Firstly, the international worker must be nominated by an Australian employer, and only then can they submit an application.
Streams of a 186 visa
The 186 visa has two streams: Temporary Residence Transition and Direct Entry.
- Temporary Residence Transition Stream: If you currently hold a 482 visa and wish to change your visa status to permanent residency, you can apply through the Temporary Residence Transition stream, provided your Australian employer is offering a permanent position.
- Direct Entry Stream: The second option for the 186 Visa is through Direct Entry. This is the ideal route for those who have never worked in Australia and have been nominated by their Australian employer or those who are ineligible under Temporary Residence Transition.
Eligibility for a 186 Visa
To qualify for this type of visa, you must:
- Be nominated by your approved Australian employer at least six months before your application date.
- Demonstrate that you have the necessary skills and qualifications for your nominated position at the time of application.
- Hold any mandatory licenses, qualifications, or memberships to be a viable candidate.
- Have proficient English skills unless you are exempt;
- Meet health and character requirements.
- Depending on which pathway you take, you will need to prove you meet all requirements outlined.
When applying under the Temporary Residence Transition stream, you must be under 45 years of age (unless exempt), have a temporary skilled shortage visa (subclass 482), and have held the same occupation for at least two years. As an exception, if you are eligible for a 186 visa under this stream, you do not need your skills reassessed.
Those applying for an ENS via Direct Entry cannot be older than 45 (unless exempt) at the time of application, hold a minimum of three years of work experience (relevant to your job/industry), have an approved skills assessment for your nominated occupation.
